Orders:

Dabel is responsible for delivering the orders only if they are transmitted in written form via email or fax to Dabel Delivery department. We would like to stress that we keep the right not to deliver the order in case if from the time the order is accepted to the time that goods is about to be dispatched, there are апу increases in cost or changes in pricelist, or if customer does not рау complete previous deliveries. Апу case Dabel keeps the right to deliver order partially if there are some reasons out of our control that stops it to make delivery in complete. Not delivered part of order will be sent as soon as possible after or with f irst next delivery.

Samples:

The samples, catalogues and апу technical documentation that are in the customer’s possession, belong to Dabel. For the production of special orders that are different than standard Dabel, technical design with an indication of quotes or a sample is required. Dabel reserves the right to make апу technical or manufacturing modifications of samples, catalogues or апу other technical documentation if it is necessary (vvithout being obliged to inform the customer).

Prices:

The prices given in the pricelist are in dinars and they can be modified in case of a sudden variation in costs or market situation.

Complaints:

Upon receiving the products, the customer should immediately check the condition of the products and if they are according to the order. Ali complaints on products quantity, outside state, need to be sent to Dabel in vvritten vvithin 10 days after the goods reception.

Delivery:

Deliveries, unless agreed differently, will be done via transporters defined by Dabel Roba. Hovvever shipment always travels on behalf of the customer and at customer’s risk. Dabel is not responsible for possible late or missing products in delivery during transportation. Dabei’s responsibility stops as soon as the transporter handles the goods. In case transportation is on the expense of a customer, the cost will be added to the invoice.

Delivery dates:

Delivery dates are planned to be approximate and not strictly defined. The customer has no right to refuse delivery in апу case orto request termination of contract or compensation for damages for апу delays.

Package:

The original package is included in the priče. The goods will be delivered with Dabel original packae and in the minimum standard packae stated in the catalogue. If the customer requires different packe, Dabel reserves the right to change and increase the priče.

Payment

Payment of the order and of the relevant delivery charges will be in compliance with the terms agreed at the time of ordering. In case of payment delay Dabel reserves the right to make the interest percent. If customer faces the situation of insolvency or of bankruptcy proceeding, Dabel may suspend or cancel orders or/and deliveries and Dabel will be paid its the debt by letter of guarantee or by forced trial payment. The customer has no right to deny, delay or refuse the payment in case of апу possible trial process is open. Debts have to be paid to Dabel and it cannot be transmitted to someone else. Payment in advance will be considered confirmed just after reception of bank receipt сору. Only then Dabel will start with production and delivery.

Reservation of the title:

Ali ordered items will be sold with reservation of title by Dabel until the priče is paid off completely. Therefore until such time as payment has been done, the customer may not install, nor loan or allovv to be seized or detrained vvithout declaring the property of Dabel (notify letter immediately),the penalty being, in the event of violation of even one of the aforementioned obligations, forfeiture of the benefit of deferred terms.

Competent court:

Ali these abovementioned terms are respecting and obeying Serbian law. For solving these issues the competent court will be Serbian Trade Court, Belgrade.

Exceptions to the conditions of this contract

Ali terms included in this contract cancel ali previous conditions and no exceptions will be allovved unless expressly accepted by Dabel.
